The Challenging Situation
Our client, an asylum seeker from Honduras, found themselves trapped in a legal grey area after entering the US through the southern border. When we requested a bond hearing, the immigration judge refused, claiming that he lacked the ‘legal authority’ to set a bond for individuals who had entered the country without inspection. This left our client facing indefinite detention, with no clear route to freedom through the immigration court system.
What We Did
We refused to accept the Immigration Judge’s self-imposed limitations. My Habeas Lawyer immediately escalated the case to the U.S. District Court by filing a Habeas Corpus petition. We challenged the government’s denial of our client’s constitutional right to an individualized custody hearing, arguing that no person should be held without a fair day in court.
The Outcome
Our federal litigation was successful. Following the court’s intervention, our client was released from detention in Maryland on a $1,500 immigration bond. This is the statutory minimum allowed under U.S. law—a remarkable victory that proved the immigration court’s initial refusal was legally flawed.
Don’t Let an Immigration Judge Have the Last Word
If an Immigration Judge told you they “don’t have the power” to grant a bond, they are only talking about their court. Federal courts have the final say on your constitutional rights. At My Habeas Lawyer, we specialize in taking the fight to the higher courts to secure the release of those the system has turned its back on.
