The Situation

Our 32-year-old client, an asylum seeker from Afghanistan living in Brooklyn, had done everything right. He had no criminal record, a steady job, and had complied with every ICE check-in for years. However, during a routine appointment on January 16th, he was abruptly taken into custody. To make matters worse, the Immigration Judge refused to even hold a bond hearing, claiming a legal precedent (Matter of Jehor Hurtado) stripped the court of the power to grant bond.

What We Did

We didn’t let the “no bond” ruling stand. Our client was detained on a Monday; by Friday of that same week, My Habeas Lawyer had already filed a formal Habeas Corpus petition in Federal Court. We argued that the government cannot bypass the Constitution’s right to due process simply by citing administrative precedents.

The Outcome

Within just 5 business days, the Federal Judge ruled in our favor, ordering an individualized bond hearing within 10 days. Because we demonstrated our client’s strong ties to the community and secured U.S. citizen sponsors, he was granted a $15,000 bond and returned to his home in New York.

Don’t Go to Your ICE Check-In Unprotected

The “check-in arrest” is a devastating tactic used against law-abiding community members. If an Immigration Judge says they “don’t have the authority” to give you a bond, they are wrong under the U.S. Constitution. At My Habeas Lawyer, we specialize in the fast-track federal litigation needed to get you out of a “no bond” situation.
